These Terms of Service ("Terms") govern your use of cuckoochalet.com (the "Site") and your purchases from Cuckoo Chalet. The Site is operated by FBA Ventures LLC, a Wyoming limited liability company ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. Please read them together with our Shipping Policy, Refund & Return Policy, and Privacy Policy, which are part of these Terms.
You must be at least 18 years old, or the age of majority in your state, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian.
We describe our clocks and parts as accurately as we can, using the makers' own specifications (movement, dimensions, functions). Cuckoo clocks are wooden objects, and many of their details are carved or painted by hand: the color, wood grain, carving and painted details of the clock you receive may differ slightly from the photos, and the tone of the cuckoo call varies a little from one clock to another. These natural variations are not defects.
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example if an item is out of stock, if there is an obvious error in the price or description, or if we suspect fraud. If we cancel an order you have paid for, we will refund you in full.
Shipping, delivery times, returns, and refunds are governed by our Shipping Policy and Refund & Return Policy.
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, or using it for any unlawful purpose. All content on the Site (texts, photos, videos, logos) belongs to us or our licensors and may not be copied for commercial use without our written permission.
We do not offer a separate written warranty. Damaged, defective, or wrong items are handled under our Refund & Return Policy. To the extent permitted by law, the Site and products are provided "as is", and we disclaim implied warranties. Some states do not allow the exclusion of implied warranties, so this exclusion may not apply to you, and you may have other rights that vary from state to state.
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or our products, and our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
If you have a problem, please email us first at contact@cuckoochalet.com. Most issues can be solved quickly. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, except where the consumer protection laws of your state of residence provide otherwise. You may bring a claim in small claims court where you live, if it qualifies.
We may update these Terms from time to time. The version in effect when you place an order applies to that order. The date at the top shows the latest update.
